MILL CREEK — Probable cause was found in the case of a Randolph County woman accused of repeatedly breaking into a residence to use the alleged victim’s washer.
Sidney Elizabeth Arbogast, 30, is charged with one count of burglary, a felony. She is currently being held at the Tygart Valley Regional Jail on a $10,000 cash-only bond.
On Monday, Arbogast appeared in Randolph County Magistrate Court for a preliminary hearing, along with attorney Paul Gwaltney. During the hearing, Randolph County Magistrate Michael Dyer found probable cause in the case, moving it forward to be considered by the Randolph County grand jury.
According to the criminal complaint, filed by Senior Trooper A.P. Petrella with the West Virginia State Police, on April 14, Petrella received a direct complaint from a witness who claimed that Arbogast had broken into the residence of an acquaintance of his on Woody Simmons Drive in Mill Creek.
Upon arrival to the scene, Petrella placed Arbogast into custody, the complaint states. The owner of the residence, who wass the alleged victim, reportedly told Petrella that this was the third time since the previous weekend that Arbogast had damaged his door “by forcing entry into the residence.”
The alleged victim stated that Arbogast had damaged the locking mechanism and the pad lock he had applied to the door prior to the most recent forced entry, according to the complaint. The value of the damages to the property are estimated to be less than $2,500.
The alleged victim told Petrella that Arbogast had also used his washer, the complaint states. Petrella reportedly observed Arbogast’s damp clothes hanging in the residence.
“(Arbogast) forced entry to reside at the residence and procure water with intent to defraud in violation of West Virginia Code § 61-3-44,” Petrella wrote in the complaint.
