The Department of Justice (DOJ) has opened an investigation into 36 Illinois school districts to assess whether parents received the required notice regarding instruction related to sexual orientation and gender identity. The Civil Rights Division is examining whether parents were informed of available opt‑out provisions and whether district policies align with federal law, including Title IX and recent court decisions addressing parental rights.
“Supreme Court precedent leaves no doubt: parents have the fundamental right and primary authority to direct the care, upbringing, and education of their children,” said Assistant Attorney General Harmeet Dhillon of the DOJ’s Civil Rights Division. “This includes exempting their children from ideological instruction that contradicts their values or decisions about their children’s health and best interests.”
The inquiry is also reviewing policies related to facility access and participation in school programs. State officials acknowledged awareness of the investigation but did not provide additional comment. The review follows similar federal actions in other states and reflects ongoing oversight of how school policies are implemented at the local level.
