Missouri lawmakers are moving to crack down on so called “claim sharks” — companies that charge veterans thousands of dollars to help file VA disability claims.
The House bill would tighten who is allowed to charge for that assistance. Its sponsor, Rep. Jim Schulte, R-New Bloomfield, says federal law is clear: no one can collect a fee until the U.S. Department of Veterans Affairs issues a decision on a claim.
“These organizations are taking money up front, and some of them are even providing doctors to help justify the claims they’re filing, and that’s not legal either,” Schulte said. “It might sound simple, but it’s a multi million dollar industry.”
Schulte points to several states that have already acted to shut down the companies and said his bill would effectively bring the same ban to Missouri.
“We’re not against anybody helping veterans, but we are opposed to them taking advantage of the veterans,” Schulte said. “In many cases, they are collecting up to five times what the initial award is for the disability. They’re fleecing the veterans for their claims money.”
Beyond limiting fees, the legislation would also restrict claim assistance companies from gaining improper access to veterans’ personal and medical information.
“These companies will get a veteran’s Social Security number, their claim numbers, and it’s even been documented some of them are then selling that information to credit card companies — businesses that will solicit them when they find out they’ve received a claim,” Schulte said.
The Missouri House of Representatives could soon debate his bill. Schulte said he’s hopeful his legislation can pass before lawmakers adjourn May 15th.
