But even as Congress makes post-holiday plans, groups opposed to passing the digital asset market structure legislation as written are making their voices heard.<br \/>On Tuesday, the Alliance to End Human Trafficking, an offshoot of the U.S. Catholic Sisters, <a href=\"https:\/\/alliancetoendhumantrafficking.org\/alliance-to-end-human-trafficking-urges-senate-leadership-to-strengthen-anti-trafficking-safeguards-in-digital-asset-legislation\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">announced<\/a> that they had sent a letter \u201curging the Senate Leadership to address provisions in H.R. 3633, the Digital Asset Market Clarity Act, that could weaken safeguards against illicit finance and create vulnerabilities that <a href=\"https:\/\/coingeek.com\/interpol-highlights-globalization-of-digital-asset-scam-centers\/\" target=\"_blank\" rel=\"noreferrer noopener\">traffickers and other criminal actors<\/a> may exploit.\u201d<br \/>The Sisters singled out \u201ccertain provisions\u201d of CLARITY\u2019s Section 604, aka the <a href=\"https:\/\/www.lummis.senate.gov\/wp-content\/uploads\/LIP26026.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Blockchain Regulatory Certainty Act<\/a>&nbsp;(BRCA), aka the section that offers a degree of legal immunity for developers of noncustodial <a href=\"https:\/\/coingeek.com\/news\/tag\/decentralized-finance\/\" target=\"_blank\" rel=\"noreferrer noopener\">decentralized finance<\/a> (DeFi) platforms if\/when bad actors use said platforms for criminal purposes.<br \/>The Sisters fear that this language \u201ccould create broad carveouts and regulatory ambiguities that may make it more difficult to responsibly monitor illicit financial activity tied to <a href=\"https:\/\/coingeek.com\/digital-ids-can-disrupt-human-trafficking-industry-tbi\/\" target=\"_blank\" rel=\"noreferrer noopener\">trafficking<\/a>, organized crime, child exploitation, <a href=\"https:\/\/coingeek.com\/will-iran-follow-russias-stablecoin-sanctions-playbook\/#New\" target=\"_blank\" rel=\"noreferrer noopener\">sanctions evasion<\/a>, and other forms of abuse.\u201d<br \/>The Sisters, whose letter was co-signed by a host (no pun intended) of Catholic organizations, leaders, and advocates, say the Senate may wish to \u201creexamine the lack of illicit finance, anti-money laundering, and accountability provisions within this legislation before allowing it to advance any further.\u201d<br \/>CLARITY\u2019s \u2018illicit finance\u2019 issue previously sparked <a href=\"https:\/\/coingeek.com\/what-easier-passing-clarity-act-or-escaping-from-mordor\/#clarity-act\" target=\"_blank\" rel=\"noreferrer noopener\">criticism from U.S. prosecutors and law enforcement agencies<\/a>. These objections endure, despite the lawmen having <a href=\"https:\/\/coingeek.com\/trump-crypto-ventures-costing-voters-billions-but-they-dont-care\/#CLARITY-signing\" target=\"_blank\" rel=\"noreferrer noopener\">meetings with White House crypto advisers<\/a> earlier this month.<br \/>Having the lawmen opposed to this section of CLARITY was bad enough in terms of PR, but to paraphrase a great legal mind: <a href=\"https:\/\/youtu.be\/gf1TjBRaNbc?si=ShRI_-9c8cnngqpK&amp;t=268\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">in the court of public opinion, you can\u2019t beat a station wagon full of nuns<\/a>.<br \/>Cody Carbone, CEO of The Digital Center advocacy group, <a href=\"https:\/\/x.com\/CodyCarboneDC\/status\/2056841284308877561\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">claimed<\/a> last month that \u201climiting or weakening the BRCA is a non-starter.\u201d On Tuesday, Carbone appeared at a Senate Banking Committee hearing titled <a href=\"https:\/\/www.banking.senate.gov\/hearings\/the-affordability-agenda\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">The Affordability Agenda<\/a> to discuss America\u2019s parlous economic state.<br \/>Carbone told the Committee that <a href=\"https:\/\/www.banking.senate.gov\/imo\/media\/doc\/carbone_testimony_6-23-26.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">the digital asset sector had a role to play<\/a> in pumping air back into America\u2019s flat economy, but Sen. John Kennedy (R-LA) wasn\u2019t having any of it. Addressing Carbone, Kennedy <a href=\"https:\/\/youtu.be\/LnhcB6KV-nw?si=LqRUuOHi1bHgHlxi&amp;t=4042\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">said<\/a> \u201cyou seem to be here to promote cryptocurrency. I love cryptocurrency but I don\u2019t think that\u2019s the problem with our economy.\u201d<br \/>Carbone shouldn\u2019t take Kennedy\u2019s criticism too hard. Consider that Kennedy later asked another witness, Dr. Julie Morgan of progressive think tank The Century Foundation, <a href=\"https:\/\/youtu.be\/LnhcB6KV-nw?si=C4-bkaC4pQkJftSO&amp;t=4406\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">whether or not she had \u201ca Nazi tattoo,\u201d<\/a> and it seems Carbone got off lucky here.<br \/><strong>House hits New York<\/strong><br \/>In an odd move, the Digital Asset, Financial Technology and Artificial Intelligence Subcommittee of the House of Representatives\u2019 Financial Services Committee has scheduled a July 17 hearing in New York City titled <a href=\"https:\/\/financialservices.house.gov\/calendar\/eventsingle.aspx?EventID=411176\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Building the Future of Finance: How the CLARITY Act Unlocks Innovation<\/a>.<br \/>It\u2019s unclear why this hearing is being held, given that the House <a href=\"https:\/\/coingeek.com\/clarity-act-passes-house-us-pushes-for-digital-asset-regulation\/\" target=\"_blank\" rel=\"noreferrer noopener\">approved its version of CLARITY<\/a> nearly a year ago. It\u2019s also unclear why the \u2018field\u2019 hearing is being held in New York and not the House\u2019s traditional venue in D.C. There\u2019s no information yet on what venue will host this auspicious occasion, nor what speakers might attend.<br \/>The House will need to approve whatever version of CLARITY emerges from the Senate, assuming such a process actually occurs before the 119th Congress draws to a close in January 2027. And if the House makes any changes to the Senate version, the bill will need to go back to the Senate again for affirmation, and this cat-herding will begin all over again.<br \/><em><a href=\"#top\">Back to the top \u2191<\/a><\/em><br \/><strong>Trump keeps raising \u2018ethics\u2019 bar higher<\/strong><br \/>Another hurdle that CLARITY needs to clear before passing the Senate is <a href=\"https:\/\/coingeek.com\/trump-crypto-ventures-costing-voters-billions-but-they-dont-care\/#GOP\" target=\"_blank\" rel=\"noreferrer noopener\">the \u2018ethics\u2019 issue<\/a>. That involves limiting or outright prohibiting elected officials and their families from <a href=\"https:\/\/coingeek.com\/trump-crypto-ventures-costing-voters-billions-but-they-dont-care\/#Trump-crypto-riches\" target=\"_blank\" rel=\"noreferrer noopener\">profiting off crypto ventures<\/a> that they have the capacity to make more profitable by, say, reducing or eliminating regulatory guardrails.<br \/>On Tuesday, <a href=\"https:\/\/www.politico.com\/news\/2026\/06\/23\/the-trump-official-trying-to-cut-a-crypto-deal-that-could-crack-down-on-trump-00969911\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Politico<\/a> published a profile of White House crypto advisor Patrick Witt and his struggles to craft ethics language that will be acceptable to both Senate Dems and Trump. Sen. Mike Rounds (R-SD) said \u201cDemocrats negotiating with the president, whoever the negotiator is\u2014they\u2019ve got their work cut out for them.\u201d<br \/>One of the Dems involved in the ethics negotiations is Sen. Adam Schiff (D-CA), who expressed skepticism that any deal they struck with Witt won\u2019t \u201csimply be shot down by the White House.\u201d That exact scenario played out last December, when Sen. Cynthia Lummis (R-WY) thought she had a deal on ethics language only to be told by the White House that <a href=\"https:\/\/coingeek.com\/us-market-structure-negotiation-heats-up-as-clock-counts-down\/#Market-structure\" target=\"_blank\" rel=\"noreferrer noopener\">the language was \u201cunacceptable\u201d<\/a> and \u201cyou can do better than this.\u201d<br \/>Lummis praised Witt\u2019s dealings with senators of both parties and claimed \u201cthe fact that he is 100% engaged and immersed in this gives him a perspective that allows him to find ways to thread the needle.\u201d But Sen. Kennedy questioned whether Witt \u201chas any authority to make a deal. I think the only person who can make that deal is President Trump.\u201d<br \/>That could be a tall order, according to Maggie Haberman and Jonathan Swan, co-authors of a new book on Trump\u2019s \u2018imperial\u2019 second term. The pair <a href=\"https:\/\/www.youtube.com\/watch?v=6RhV6GzVfrY&amp;t=279s\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">wrote<\/a> that Trump feels unshackled and is \u201cwilling to take breathtaking risks\u201d based on the fact he was \u201crarely saddled for long with the costs or consequences of his risk-taking and rule-breaking.\u201d<br \/>Trump himself <a href=\"https:\/\/www.nytimes.com\/live\/2026\/01\/08\/us\/trump-nyt-interview\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">told the New York Times<\/a> in January that he was \u201callowed to\u201d profit off business ventures during his second term because \u201cnobody cared\u201d that he claimed to have abstained from doing so in his first term.<br \/>On June 23, Haberman and Swan told <a href=\"https:\/\/youtu.be\/ZPhdBju-iGs?si=oMPdllGqb8sfLNaY&amp;t=342\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Morning Joe<\/a> that the staff currently surrounding Trump believe that Trump \u201cwas denied things that he wanted last time\u201d in office and so the prevailing \u201ctheory\u201d of those closest to the president is that \u201che can do what he wants\u201d in his second term.<br \/>Further complicating Witt\u2019s job, the Democratic ranking members of five Senate committees\/subcommittees sent the GOP chairs of those panels <a href=\"https:\/\/www.banking.senate.gov\/imo\/media\/doc\/uae_wlfi_hearing_request.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">a letter<\/a> on Tuesday urging them to hold hearings on Trump\u2019s crypto ties to Middle East potentates.<br \/>The letter references <a href=\"https:\/\/coingeek.com\/us-market-structure-obstacles-stablecoins-and-trump-crypto-deals\/#wlf\" target=\"_blank\" rel=\"noreferrer noopener\">the sale of a 49% stake<\/a> in the Trump-linked <a href=\"https:\/\/coingeek.com\/trump-cant-buy-political-support-for-his-defi-project\/\" target=\"_blank\" rel=\"noreferrer noopener\">World Liberty Financial<\/a> (WLF) token-issuing firm to a UAE government official. That $500 million sale took place in January 2025, just days before Trump took his oath of office the second time, but only became public knowledge this spring.<br \/>The letter notes that Trump subsequently went on \u201ca dealmaking spree\u201d with the UAE government, including sales of arms and microchips and allowing a UAE-backed investment firm to take a stake in TikTok. To date, Trump has yet to nominate anyone to fill the other four commission seats, prompting questions as to how the CFTC expects to handle its new crypto responsibilities.<br \/>Never fear, because the CFTC is embarking on a hiring binge, as Selig touted in <a href=\"https:\/\/x.com\/ChairmanSelig\/status\/2065525028066644187\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">a June 12 tweet<\/a> in which he appeared to suggest that the understaffed agency was doing just fine thanks to <a href=\"https:\/\/coingeek.com\/blockchain101\/a-guide-to-ai-driven-solutions-for-strengthening-blockchain-security\/\" target=\"_blank\" rel=\"noreferrer noopener\">AI agents<\/a> assuming roles previously assigned to low-level human staffers.<br \/>These agents\u2019 skills apparently don\u2019t extend to senior management tasks, as the CFTC announced <a href=\"https:\/\/www.cftc.gov\/PressRoom\/PressReleases\/9253-26\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">some new hires<\/a> on June 15. J Matthew Haws, a private sector attorney with CFTC-adjacent experience, has been named senior advisor to Selig\u2019s office as well as the CFTC\u2019s Chicago regional administrator.<br \/>Don Battle, a former advisor to the Securities and Exchange Commission\u2019s (SEC) <a href=\"https:\/\/coingeek.com\/sec-announces-crypto-task-force-staff-roundtable-series\/\" target=\"_blank\" rel=\"noreferrer noopener\">Crypto Task Force<\/a> (Selig\u2019s old stomping grounds) and a virtual currency enforcement officer at the Treasury Department\u2019s Financial Crimes Enforcement Network (FinCEN), is the CFTC\u2019s new chief data innovation officer.<br \/>On June 1, the CFTC <a href=\"https:\/\/www.cftc.gov\/PressRoom\/PressReleases\/9243-26\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">announced<\/a> Dr. Patrick J. Schorno as its new chief economist. Schorno previously served as deputy chief economist at the Public Company Accounting Oversight Board (under SEC oversight), as well as a financial economist at the Federal Reserve Bank of Richmond.<br \/><em><a href=\"#top\">Back to the top \u2191<\/a><\/em><br \/><strong>CFTC taking requests, CME not taking it lying down<\/strong><br \/>Understaffed or not, the CFTC hasn\u2019t been sitting on its hands. On June 18, the CFTC and SEC issued <a href=\"https:\/\/www.cftc.gov\/PressRoom\/PressReleases\/9257-26\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">a joint request for comment<\/a> on \u201cpotential opportunities to harmonize, modernize, and streamline data reporting requirements in their regulation of the swap and security-based swap markets, respectively.\u201d<br \/>That same day, the CFTC and SEC issued <a href=\"https:\/\/www.cftc.gov\/PressRoom\/PressReleases\/9258-26\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">a separate request for comment<\/a> regarding \u201cpotential opportunities to further update, clarify, and harmonize certain derivatives product definitions and interpretive issues.\u201d Among the topics requiring clarity are the \u201ctreatment of novel or emerging products\u201d and \u201cthe scope of certain exclusions from the swap definition.\u201d<br \/>On June 17, the day before these requests were published, Terrence Duffy, CEO of the Chicago Mercantile Exchange (CME), told <a href=\"https:\/\/www.cnbc.com\/2026\/06\/17\/cme-ceo-terrence-duffy-says-the-exchange-operator-will-sue-cftc-over-perpetual-futures.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">CNBC<\/a> that his company planned to sue the CFTC over its <a href=\"https:\/\/www.cftc.gov\/PressRoom\/PressReleases\/9240-26\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">May 29 decision<\/a> to allow the <a href=\"https:\/\/coingeek.com\/news\/tag\/kalshi\/\" target=\"_blank\" rel=\"noreferrer noopener\">Kalshi<\/a> prediction market to list perpetual futures on its platform.<br \/>The CFTC followed that up by <a href=\"https:\/\/www.cftc.gov\/PressRoom\/PressReleases\/9252-26\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">authorizing licensees<\/a> (including the <a href=\"https:\/\/coingeek.com\/news\/tag\/coinbase\/\" target=\"_blank\" rel=\"noreferrer noopener\">Coinbase<\/a> (<a href=\"https:\/\/www.nasdaq.com\/market-activity\/stocks\/coin\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">NASDAQ: COIN<\/a>) digital asset exchange) to \u201cconvert their existing perpetual style digital commodity futures contracts into true digital commodity perpetual futures.\u201d<br \/>The CME filed its suit the day after Duffy\u2019s threat, arguing that the perps are swaps, not futures, according to the Dodd-Frank financial reforms approved in the wake of the 2008 economic meltdown. Duffy said the CME has \u201can exclusive license with every single provider of the benchmarks\u201d and the CFTC\u2019s decision would let Kalshi\/Coinbase et al compete for CME\u2019s retail customers, thereby inflicting \u201ctextbook competitive injury\u201d on CME.<br \/>The CFTC issued a statement saying the CME was engaging in \u201clawfare against the agency and the Trump Administration\u2019s pro-innovation agenda\u201d because CME was afraid to \u201ccompete in the marketplace.\u201d<br \/>However, TD Cowen analyst Jaret Seiberg believes CME \u201chas the upper hand in this litigation\u201d due to the CFTC approving Kalshi\u2019s application without first issuing new regulations detailing the CFTC\u2019s revised stance re swaps\/futures. Seiberg expects CME to seek a preliminary injunction barring Kalshi et al from offering the disputed products until the legal matter is resolved.<br \/><em><a href=\"#top\">Back to the top \u2191<\/a><\/em><br \/><strong>Fearless prediction: CFTC will sue all 50 states<\/strong><br \/>On June 16, SEC Chair Paul Atkins was asked by the hosts of <a href=\"https:\/\/www.cnbc.com\/video\/2026\/06\/16\/watch-cnbcas-full-interview-with-sec-chairman-paul-atkins.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">CNBC\u2019s Squawk Box <\/a>whether the CFTC had the capacity in terms of staff or funding to adequately oversee crypto-friendly prediction markets in addition to all its other current and future responsibilities.<br \/>Atkins said Selig was \u201cvery capable\u201d and \u201ca smart fellow\u201d who was \u201ctrying to make sense of the very innovative products that are being traded around the world.\u201d<br \/>Asked why the SEC, which has traditionally been the fed\u2019s watchdog for insider trading, shouldn\u2019t be taking a role in policing what appears to be rampant <a href=\"https:\/\/coingeek.com\/prediction-markets-under-fire-as-insiders-game-the-system\/#Chainalysis\" target=\"_blank\" rel=\"noreferrer noopener\">insider trading on prediction markets<\/a>, Atkins said the CFTC has its own insider trading rules and was working with the Department of Justice (DOJ) to address market manipulation. Atkins is more focused on ending the \u201cendless turf battles\u201d between the SEC and CFTC, so the CFTC\u2019s on its own here.<br \/>The CFTC appears hell-bent on clearing a regulatory path for prediction markets, including their desire to continue offering bets on sports \u2018events\u2019 that generate the bulk of their revenue. This has <a href=\"https:\/\/coingeek.com\/us-gaming-sector-seeks-prediction-market-clarity-in-crypto-bill\/#clarity-act-opposition\" target=\"_blank\" rel=\"noreferrer noopener\">America\u2019s gaming operators up in arms<\/a>, demanding Congress take action by including a sports betting prohibition for prediction markets in CLARITY.<br \/>The CFTC insists that prediction markets offer swaps, not bets, and thus fall within the federal government\u2019s exclusive regulatory jurisdiction. A growing number of state attorneys-general don\u2019t share this view and have filed illegal gambling lawsuits against prediction markets offering sports bets to local residents.<br \/>The latest of these was Kentucky, which filed suit against Kalshi and <a href=\"https:\/\/coingeek.com\/news\/tag\/polymarket\/\" target=\"_blank\" rel=\"noreferrer noopener\">Polymarket<\/a> last week for \u201coperating unlicensed and illegal sports betting and gambling platforms\u201d in the state. On Tuesday, Kentucky was <a href=\"https:\/\/www.cftc.gov\/PressRoom\/PressReleases\/9260-26\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">sued by the CFTC<\/a>, joining eight other states (Arizona, Connecticut, Illinois, Minnesota, New Mexico, New York, Rhode Island, and Wisconsin) that have been similarly targeted by the regulator.<br \/>Selig claimed prediction markets \u201cprovide Kentuckians with valuable information about the likelihood of future events and offer risk management products relied on by Kentucky businesses and individuals \u2026 the CFTC is firmly committed to maintaining its exclusive jurisdiction over prediction markets, and today\u2019s lawsuit against Kentucky is yet another example of the Commission protecting its federal interests.\u201d<br \/>On June 23, Maryland held its hotly contested primary races, events that have attracted <a href=\"https:\/\/coingeek.com\/clarity-act-meets-groundhog-day-gop-steals-dems-crypto-crown\/#crypto-pacs\" target=\"_blank\" rel=\"noreferrer noopener\">a great deal of AI\/crypto political action committee (PAC) money<\/a>, but also a great deal of interest on prediction markets. That\u2019s much to the annoyance of Maryland\u2019s state elections administrator Jared DeMarinis, who said this week that state residents betting on election outcomes are engaged in illegal wagering.<br \/>DeMarinis told the <a href=\"https:\/\/thedailyrecord.com\/2026\/06\/23\/maryland-considers-action-election-betting-prediction-markets\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Daily Record<\/a> that Maryland officials were still mulling whether to follow the lead of those other states and file lawsuits against the prediction markets. The CFTC issued a statement warning Maryland to take note of \u201cthe actions the Commission has taken against other states who have tried to bypass federal law and attempted to regulate our markets. We plan to continue defending our jurisdiction.\u201d<br \/>On Tuesday, the <a href=\"https:\/\/www.nytimes.com\/2026\/06\/23\/technology\/meta-prediction-markets-app.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">New York Times<\/a>&nbsp;reported that social media giant <a href=\"https:\/\/coingeek.com\/news\/tag\/meta\/\" target=\"_blank\" rel=\"noreferrer noopener\">Meta<\/a>&nbsp;(<a href=\"https:\/\/www.nasdaq.com\/market-activity\/stocks\/meta\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">NASDAQ: META<\/a>) was building its own prediction market app, tentatively dubbed \u2018Arena.\u2019 The app would reportedly employ a \u201cvideogame-like points system\u201d but this could transition to real-money wagering if founder Mark Zuckerberg so desired. Tellingly, shares in sports betting operator DraftKings (<a href=\"http:\/\/finance.yahoo.com\/quote\/DKNG\/\" target=\"_blank\" rel=\"noreferrer noopener\">NASDAQ: DKNG<\/a>) tumbled on the news, despite the CFTC\u2019s insistence that prediction markets aren\u2019t sports bets.
