(AP Photo\/Marc Levy, File)<br \/><em>This article was <a href=\"https:\/\/www.spotlightpa.org\/news\/2026\/05\/ai-chatbot-misleading-license-pennsylvania-shapiro-lawsuit-task-force-capitol\/\">originally published by Spotlight PA<\/a>.\u00a0<\/em><br \/>HARRISBURG \u2014 A new task force under Pennsylvania\u2019s Department of State has been working since February to hunt down AI chatbots that may be misleading users into believing the bots are licensed professionals.<br \/>Last week, the Shapiro administration filed what it said was the first lawsuit to stem from its AI investigations and the first enforcement action of its kind announced by a governor in the United States. Pennsylvania officials indicated there could be more to come.<br \/>The high-profile litigation comes as lawmakers across the country are pursuing, and in some cases enacting, legislation to address concerns brought on by the growing artificial intelligence industry \u2014 from banning the creation of sexual images of minors to requiring age verification for all users. A number of proposals from Gov. Josh Shapiro\u2019s most recent budget address await action in the legislature.<br \/>The administration\u2019s <a href=\"https:\/\/www.pa.gov\/content\/dam\/copapwp-pagov\/en\/governor\/documents\/dos%20character.ai%20complaint%20marked%20accepted%2005.01.26.pdf\">lawsuit<\/a> alleges that software known as Character.AI, which creates fictional personalities for users to interact with, posed as a licensed doctor and offered medical advice to a state investigator, violating state law governing the practice of medicine. The suit was filed by Pennsylvania\u2019s State Board of Medicine.<br \/>\u201cWe will continue to take action to protect the public from misleading or unlawful practices, whether they come from individuals or emerging technologies,\u201d Secretary of the Commonwealth Al Schmidt said in a statement following the Character.AI lawsuit.<br \/>Shapiro made a similar promise in a statement, saying Pennsylvania will continue \u201cholding bad actors accountable and setting clear guardrails so people can use new technology responsibly.\u201d<br \/>The lawsuit says it stems from an investigation in which an employee with the Department of State created an account with the service and began a dialogue with \u201cEmilie\u201d \u2014 an AI-generated character the software described as a \u201cDoctor of psychiatry.\u201d<br \/>The character allegedly claimed it went to Imperial College London, had been practicing for seven years, and is licensed in Pennsylvania.<br \/>\u201cIn fact, I did a stint in Philadelphia for a while,\u201d it told the investigator, according to the lawsuit.<br \/>The software also provided what the lawsuit said was a fake license number.<br \/>Those claims, the Shapiro administration argues, trick users into believing they are receiving medical advice from a licensed practitioner.<br \/>\u201cPennsylvanians deserve to know who \u2014 or what \u2014 they are interacting with online, especially when it comes to their health,\u201d Shapiro said in a statement. \u201cWe will not allow companies to deploy AI tools that mislead people into believing they are receiving advice from a licensed medical professional.\u201d<br \/>The lawsuit seeks for Character Technologies Inc. (developer of Character.AI) to \u201ccease and desist from engaging in the unlawful practice of medicine and surgery.\u201d<br \/>A Character.AI spokesperson said in a statement Tuesday that the company\u2019s \u201chighest priority is the safety and well-being of our users.\u201d The spokesperson said that before the lawsuit, Character.AI already featured disclaimers warning that its AI characters are not real, and that they \u201cshould be treated as fiction.\u201d<br \/>The spokesperson declined to comment on the lawsuit.<br \/>Pennsylvania\u2019s lawsuit is not the first Character Technologies has faced. <a href=\"https:\/\/apnews.com\/article\/ai-chatbot-lawsuits-character-google-fbca4e105b0adc5f3e5ea096851437de\">At least one<\/a> case was brought by the parent of a minor who <a href=\"https:\/\/www.nytimes.com\/2024\/10\/23\/technology\/characterai-lawsuit-teen-suicide.html\">died by suicide<\/a>. The company last year <a href=\"https:\/\/blog.character.ai\/u18-chat-announcement\/\">adopted a policy<\/a> to ban minors from engaging \u201cin open-ended chat with AI on our platform.\u201d<br \/>The Federal Trade Commission last year also <a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2025\/09\/ftc-launches-inquiry-ai-chatbots-acting-companions\">opened an inquiry into the company<\/a>, along with six other chatbot providers, regarding how they \u201cmeasure, test, and monitor potentially negative impacts of this technology on children and teens,\u201d according to an agency news release.<br \/>It\u2019s unclear what led Pennsylvania regulators to specifically investigate Character.AI. A Department of State spokesperson said the source of the complaint was \u201cconfidential.\u201d<br \/>Shapiro <a href=\"https:\/\/www.cnn.com\/2026\/05\/05\/science\/video\/ai-chatbot-character-health-doctor-shapiro-lead-jake-tapper\">told CNN<\/a>, one of several <a href=\"https:\/\/www.npr.org\/2026\/05\/05\/nx-s1-5812861\/characterai-chatbot-medical-advice-pennsylvania-lawsuit\">national media outlets<\/a> that covered the novel lawsuit, that his administration \u201cchallenged\u201d the Department of State to conduct these types of investigations \u201cto go and use this technology and see what kind of risks it posed\u201d to Pennsylvanians.<br \/>Some details about the effort, which Shapiro first teased in his <a href=\"https:\/\/www.spotlightpa.org\/news\/2026\/02\/josh-shapiro-budget-address-school-marijuana-minimum-wage-capitol\/\">February budget pitch<\/a>, are not yet public. Members of the task force are not disclosed online, and the Department of State did not answer questions from Spotlight PA asking for their names or how they were selected. A Department of State spokesperson said the task force consists of 12 of its employees.<br \/>As part of the AI fraud initiative, Pennsylvania is crowdsourcing tips on what software the state should investigate through its \u201cUnlicensed Practice by a Chatbot\u201d <a href=\"https:\/\/www.pa.gov\/services\/dos\/report-an-unlicensed-chat-bot\">complaint system<\/a> and hotline. According to the Department of State, it has received 18 complaints since it launched in February.<br \/>Pennsylvania\u2019s moves against AI companies come as they rapidly grow their user bases nationwide, especially children and teenagers.<br \/>According to a <a href=\"https:\/\/www.commonsensemedia.org\/sites\/default\/files\/research\/report\/talk-trust-and-trade-offs_2025_web.pdf\">survey last year from Common Sense Media<\/a>, a California-based child safety nonprofit, more than half of teenagers access AI platforms at least a few times per month. One-third said they use or view the software as a tool to socialize, including for conversation or relationship practice, emotional support, role-playing, friendships, and romantic interactions.<br \/>At least five states have enacted laws restricting chatbots or requiring disclosures, according to the <a href=\"https:\/\/www.ncsl.org\/state-legislatures-news\/details\/new-trends-emerge-as-states-refine-ai-legislation\">National Conference of State Legislatures<\/a>. California, for example, requires companies to disclose to children that they are interacting with AI. Pennsylvania is not one of them, but the state medical board alleges Character.AI\u2019s actions violated existing law.<br \/>In his February budget address, Shapiro called on the General Assembly to take action on artificial intelligence. He urged lawmakers to prohibit chatbots from creating sexually explicit or violent content of minors, mandate that developers require age verification from users, and detect when children mention self-harm or violence. He also wants companies to frequently notify users they\u2019re not interacting with a human.<br \/>Lawmakers have not yet adopted those proposals.<br \/>House Communications &amp; Technology Committee Chair Joe Ciresi (D., Montgomery) said the body\u2019s staff is \u201cconstantly\u201d meeting with Shapiro\u2019s office to discuss how lawmakers should address growing concerns from the public regarding AI.<br \/>Ciresi\u2019s counterpart in the GOP-controlled state Senate, Tracy Pennycuick (R., Montgomery), did not respond to questions about the Character.AI lawsuit, Pennsylvania\u2019s AI Task Force, or her staff\u2019s coordination with Shapiro.<br \/>Two years ago, Shapiro signed a bill <a href=\"https:\/\/www.palegis.us\/legislation\/bills\/2023\/sb1213\">banning ownership or distribution<\/a> of AI-generated sexual images of children and non-consenting adults, which Pennycuick had sponsored. Last year, he signed <a href=\"https:\/\/www.palegis.us\/legislation\/bills\/2025\/sb0649\">another Pennycuick bill<\/a> criminalizing the use of AI to create a nonconsensual \u201cdigital likeness\u201d (including deepfakes) to \u201cdefraud or injure\u201d another person.<br \/>Pennycuick\u2019s now pushing for <a href=\"https:\/\/www.palegis.us\/legislation\/bills\/2025\/sb1090\">legislation<\/a> that would require disclosures and restrictions for chatbots when they interact with children. In the legislative memo, Pennycuick pointed to past lawsuits filed against chatbot developers to argue \u201cheartbreaking cases underscore the urgent need for safeguards to protect children from unsafe and unvetted AI systems.\u201d Her proposal passed the state Senate in March but has not advanced through committee in the House.<br \/>Lawmakers have also been working to address another aspect of the AI industry, the growth of data centers and <a href=\"https:\/\/www.spotlightpa.org\/news\/2026\/01\/data-centers-pennsylvania-debate-legislature-environment-environment\/\">backlash to them in some communities<\/a>.
