TSA Delays Amid Government Shutdown Raise Questions About Workplace Rights – WRGB

CAPITAL REGION, N.Y. (WRGB) -Travelers across the country are facing unusually long airport security lines due to a partial government shutdown and staff shortages at the TSA, leading many to wonder about their rights if they miss work because of delays.
In some cases, passengers have reported waiting more than four hours in security lines, resulting in missed flights and disrupted schedules. Managing partner Paul Harding from the law firm Harding Mazzotti joined CBS6 to explain what employees can expect in such situations.
“In New York State, we’re what they call an at-will employment state, meaning you can be fired at will,” Harding said. “Even if it’s no fault of your own—like missing a flight because TSA delays—you could technically be let go.”
Harding emphasized, however, that legal recourse is possible under certain circumstances, such as discrimination based on age, gender, religion, or other protected categories. Outside of those protections, most employees remain at-will and can be terminated without cause.
Questions have also arisen about the role of airlines in these delays. Harding noted that while there could be a theoretical claim against an airline, pursuing one is often impractical due to the size and resources of major carriers.
The partial shutdown has left many TSA officers working without pay since mid-February. Harding praised the officers for their professionalism despite challenging conditions, noting that travelers have shown gratitude with small gestures like gift cards.
“Seeing them keep the country moving under these circumstances is remarkable,” Harding said.
As disruptions continue, travelers are encouraged to plan extra time for security and to stay informed about potential delays at airports.
